Personal Information Collection Statement of MOOV (Hong Kong) Limited – The MOOV Shop

This Personal Data Collection Statement (this “Statement”) is issued by MOOV (Hong Kong) Limited (“MOOV”, “we” or “us” ) and applies between the MOOV and you (“You” or the “Customer”) regarding the website The MOOV Shop (the “E-Shop”) in the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”).

This Statement should be read together with the terms and conditions for the E-Shop issued by MOOV (the “Terms and Conditions”) stated in the Delivery Information Form after you placed a selected product/products in the cart and before checking out (the “Form”) (https://www.moovshop.com/en/checkout) under the order confirmation section of the E-Shop, provided that, in the event of any inconsistency between this Statement and the Terms and Conditions concerning matters relating to personal data, this Statement shall prevail. For the avoidance of doubt, the details of the collection, compilation, retention, use, disclosure and processing of your personal data and any further information about the Offer and/or Services set out in the Privacy Statement of PCCW Limited (https://www.pccw.com/privacy-statement/for-customers/index.page?locale=en) (the “PCCW Privacy Statement”) shall be incorporated into this Statement in its entirety.

MOOV is part of or associated with the PCCW group of companies including but not limited to itself, PCCW Limited and their respective affiliated, associated or related companies from time to time (as the case maybe) but excluding members of the HKT group (being HKT Limited and its subsidiaries) (the “PCCW Group”) (the PCCW Group companies and joint venture companies are together referred to as “Affiliates”).

Kinds of personal data collected and Purposes for which we use your personal data

You are required to provide your name, contact number, email, and (if required) the recipient’s name, contact number and address for delivery of the recipient from shipping/delivery (whether for yourself and/or any third party you submitted for and on that third party’s behalf) in the Form and/or other relevant forms, documents or any other means (collectively, the “Channels”), for the following purposes in addition to the purposes as stated under the “How we use your Data” section in the PCCW Privacy Statement (collectively, the “Purposes”):

For the avoidance of doubt, if/where applicable, we will indicate which kind of personal data is mandatory or optional for you to provide at the relevant time of data collection, e.g. during the Form filling.

If you do not provide us with the aforementioned required personal data on a voluntary basis, we may not be able to perform the Purposes and/or (subject to your consent) provide relevant Services (as defined in the PCCW Privacy Statement) to you.

If you are under 18 years of age, you should consult with your parent or legal guardian before sharing or providing the personal data to us. To protect your interest as a minor, even if you agree for us to use and disclose the personal data for the Purposes, you shall require your parent or legal guardian to give consent on your behalf before we proceed to so use and disclose your personal data.

Persons to whom we may disclose your personal data

Your personal data may be used or maintained by and/or disclosed to, at all times to the extent permitted under applicable data protection laws and where applicable licence requirements, those entities as identified under the “Our legal basis for using your Data including how we disclose your Data” section in the PCCW Privacy Statement, in particular, the Affiliates, their respective agents (including debt collection agent), licensors, providers, and business partners for purposes in connection with the the E-Shop, the Ordered Product and/or the Services, including without limitation providing the Ordered Product and/or the Services to you, enabling your access to the E-Shop, enabling delivery of the Ordered Product to you or your picking up of the Ordered Product, and enabling your access and retrieval of information under the E-Shop and/or the Services. We may also disclose your personal data to applicable regulatory bodies or governmental authorities for complying with the applicable data protection laws. 

Direct Marketing

Personal data collected from the Channels and/or in any sale-related circumstances will not be used for direct marketing purposes.

Your Rights

You can find details of your rights under the “Your Right to access, correct and delete Data” section in the PCCW Privacy Statement.  For the avoidance of doubt, you are also entitled to access, correct or enquire about your personal data being held by us. For any such request, please do so by writing to the Group Data Protection Officer of MOOV (Hong Kong) Limited at GPO Box 9872, Hong Kong or via email to privacy@pccw.com. We may impose a reasonable charge on any such request.

Inconsistency or conflict

In case of any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.

Miscellaneous

This Statement may be updated from time to time to reflect changes to MOOV’s policy with respect to personal data protection and/or changes to the applicable data protection laws. Where there are significant changes, MOOV will notify you and obtain your acceptance of the changes, consents, and/or opt in (as necessary or applicable). If you do not accept the changes and/or provide your consent, then MOOV may not be able to perform the Purposes and/or provide the Services to you. You are advised to check the Website portal for updates to this Statement (https://www.moovshop.com/en/pics) on a regular basis.

Nothing in this Statement shall limit your rights under the Personal Data (Privacy) Ordinance (Chapter 486 of the laws of Hong Kong).

This Statement shall be governed by, and construed in accordance with, the laws of Hong Kong.
